3. Formation of the Contract, Process of Ordering

3.1. The Client may indicate their intention to order the Service (hereinafter: Offer) to the Service Provider in several ways:

  • a) by filling out and submitting the form found on the website;

  • b) via e-mail, telephone, or other electronic messages (e.g., on social media platforms), clearly stating which service or individually negotiated offer they wish to order.

3.2. The Offer becomes accepted by the Service Provider when the Service Provider records the most important details of the order (e.g., content of the service, price, and payment terms) in a written confirmation (typically via e-mail) addressed to the Client. The contract is formed between the Parties upon this written confirmation, regardless of the original channel of the order.

3.3. The final date of the photoshoot is subject to mutual agreement following the formation of the contract. As a condition for reserving the date, the Service Provider may request the payment of a deposit, the amount of which is typically [e.g., 30-50%] of the chosen package price. The amount of the deposit counts towards the total purchase price of the service. The order becomes final only upon receipt of the deposit.

4. Payment Terms

4.1. The Client shall pay the deposit via bank transfer to the bank account number provided by the Service Provider in the confirmation e-mail. 4.2. The Client is obliged to pay the remaining balance in cash on the day of the photoshoot at the location, or via bank transfer after the photoshoot but prior to the delivery of the finished images. 4.3. The Service Provider shall issue an invoice regarding the payment in accordance with the effective legal regulations.

  • No-show: The 50% deposit is forfeited. The remaining fee will not be charged in this case.

  • Modification within 72 hours: 20% of the total service fee will be charged as a modification fee.

  • Further modifications (beyond the first free occasion): Subject to consultation, but a modification fee of at least +20% is to be expected.

  • External costs (e.g., studio rental/booking fee) are borne by the Client even in the case of modification, if the studio charges for them.

  • External costs (Studio, Subcontractors): The cancellation/modification terms of the studio rental are determined by the studio. If the studio charges a fee for the booking or does not refund it, this is borne by the Client. Any costs and cancellation terms of other subcontractors (e.g., makeup artist, hairdresser, assistant) apply according to the contract of the respective service provider.

5.3. Refunds Refunds are made via bank transfer to the same source within 5–10 business days. Transaction/banking fees not refunded by the payment service provider may be deducted.

Upon full payment of the purchase price, the Client acquires a non-exclusive right of use regarding the images, unlimited in time and territory. 7.2. The Client may freely use the images for private purposes (e.g., sharing on social media, placing in a family album, printing). Commercial use of the images (e.g., resale, advertising material) is possible only with the prior written permission of the Service Provider and upon payment of a separate fee. 7.3.
